Psystar (the Apple clone maker) got dealt a huge blow to it's operations yesterday.  It's counter-suit to Apple was dismissed by the judge, siting a healthy competition in the computer manufacturing industry.  Users are always allowed to choose their system, whether it be Apple, Microsoft or Linux.  The judge said that Psystar had said in it's own claim that Apple did not have a monopoly, since "Mac OS performs the same functionality as other operating systems".

Psystar has until December 8th to file an appeal.

even though this counter suit is dropped it doesn't have anything to do with the main issue and I don't think Psystar is doing anything wrong by selling computers that are preloaded with the Mac OS
